Terms of service

Welcome to Mochi. These terms are the agreement between you and Studiosso S.L. ("Mochi", "we", "us") for using the app. By continuing — tapping the sign-in button, creating an account or using any specialist — you confirm you've read them and accept them. If something doesn't sit right, please don't use the app and write to hola@heymochi.app so we can understand what happened.

Who can use Mochi. You must be at least 13 years old to create an account. If you live in Spain or any country in the European Economic Area and you're under 14, you also need consent from a parent or legal guardian — Spain's LOPDGDD requires it. If you're between 13 and 17, you confirm your guardian is aware. We don't design Mochi for children under 13 and, if we discover an account belonging to one, we close it and delete the data.

Your account. You sign in with Apple or Google — we don't store passwords. You're responsible for keeping your session secure and for what gets posted from your account. If you think someone is using it without your permission, let us know.

Acceptable use. Mochi is built for honest conversation, study, writing and creativity. Please don't use it for: illegal content or content that infringes on third-party rights, other people's private information (national IDs, medical data, intimate photos without consent), hate speech, harassment, sexually explicit content of real people, attempts to generate malware, fraud, impersonation or circumvention of security measures. Also, please don't try to extract our models, reverse-engineer the app, or resell it or its responses. If you abuse the service we may suspend or terminate your account without prior notice.

Your content. What you write and upload — messages, memory little things, photos, voice samples — stays yours. For the app to work we need a limited license to process it: send your prompt to the right model, store it in your account so you can re-read it, and show it back to you. That license ends when you delete the content or the account. We don't use your data to train AI models — neither ours nor Anthropic's, Google's or OpenAI's; this is contractually guaranteed by each provider.

Limits of AI. Responses are generated by models from Anthropic (Claude), Google (Gemini, including Nano Banana for images) and OpenAI (text embeddings). Models can be wrong, hallucinate facts, or sound very confident while being mistaken. Mochi is not a medical, legal, financial, mental-health or educational professional. Use it with judgment and consult a qualified person before making important decisions. If something it says concerns you, report it from Settings → Report a response.

Subscriptions and mocha beans. The free plan gives you 30 beans to start and 5 more each day as a harvest — no daily cap, balance only. Mochi+ costs $6.99/month (with a 7-day free trial) or $49.99/year and includes 200 beans every month (non-accumulable: anything unused at renewal returns to the pool) plus perks like per-action discounts and access to Halo. Mochi+ is an auto-renewable subscription through the Apple App Store; the charge is made to your Apple ID when you confirm the purchase and renews automatically at the end of each period unless you cancel at least 24 hours before from iPhone Settings → Apple ID → Subscriptions. One-off bean packs (100 beans for $4.99, 300 beans for $9.99, 1,000 beans for $24.99) are non-refundable purchases unless local law requires otherwise. Refunds are handled by Apple under their policy (reportaproblem.apple.com); we don't have direct access to your payment method.

Your personal data. The detail lives in our privacy policy (Settings → Privacy). It explains what data we process, the GDPR legal basis we rely on, how to exercise your rights of access, rectification, erasure, portability, objection and restriction, and how to reach the data protection officer.

Termination. You can leave anytime from Settings → Delete account; we wipe your data within 30 days. We may suspend or end the service if you breach these terms, if the law requires it, or if we stop operating the app — in that last case we'd give you reasonable advance notice.

Governing law and disputes. These terms are governed by Spanish law. If you live in Latin America (Mexico, Argentina, Colombia, Chile, Peru, Uruguay, Costa Rica) or in another EU country, you keep all the mandatory rights granted by the consumer law of your country of residence and you can file complaints with the relevant local agencies (Profeco in Mexico, Sernac in Chile, SIC in Colombia, Indecopi in Peru, etc.). EU consumers can also use the European Commission's online dispute resolution platform (ec.europa.eu/consumers/odr).

Changes to the terms. If we update something meaningful we'll let you know inside the app before it takes effect. Continued use after the notice means you accept the new version. We keep prior versions available on request.
